Top 6 Form W-8BEN Mistakes That Trigger 30% Withholding

Common documentation errors that cause U.S. withholding agents and payment platforms to reject Form W-8BEN submissions:

1. Leaving Part II Treaty Claim Blank
If you qualify for a 0% treaty rate but leave Part II blank, payers must withhold the default 30% tax under IRC § 1441.
2. Using a P.O. Box as Permanent Address
Line 3 requires a physical residential street address. P.O. Boxes and "in-care-of" addresses are rejected by the IRS.
3. Missing Foreign Tax ID (FTIN Line 6a)
To claim treaty benefits, you must enter your home tax ID (PAN, UTR, SIN, TFN). Without it, treaty relief cannot be certified.
4. Using W-8BEN for a Business Entity
Form W-8BEN is strictly for individual beneficial owners. Registered corporations and foreign LLCs must file Form W-8BEN-E.
5. Submitting Directly to the IRS
Form W-8BEN is never mailed to the IRS. Give it directly to your U.S. withholding agent, client, or platform to keep on file.
6. Forgetting the 3-Year Expiration Date
Form W-8BEN expires on December 31 of the third full calendar year after signing. Expired forms trigger automatic 30% tax.
